This is the second report of the Joint State Government Commission Advisory Committee on Domestic Relations Law and is limited to recommendations regarding custody. The first report, issued in April 1999, focused on proposed Divorce Code amendments.
Senate Resolution No. 43 of 1993, Pr.'s No. 1673 (adopted February 1, 1994), created the Task Force and Advisory Committee on Domestic Relations Law. It directed the Commission to undertake an ongoing study of domestic relations law, but excluded the subjects of child abuse and adoption. The advisory committee is chaired by Judge Emanuel A. Bertin of Montgomery County. The task force, chaired by Senator Stewart J. Greenleaf, is comprised of the majority and minority chairs of the Senate and House Judiciary Committees and the Senate and House Aging and Youth Committees.
The subcommittee on Custody (Maria P. Cognetti, Chair) developed the recommendations regarding custody which the advisory committee then considered.
At its meeting of October 25, 1999, the legislative task force received this report of the advisory committee and authorized its transmittal to the General Assembly. This report contains proposed legislation for a revised Subchapter A of Chapter 53 (Custody Generally) and proposed Chapter 54 (Uniform Child Custody Jurisdiction and Enforcement Act) of Title 23 (Domestic Relations) of the Pennsylvania Consolidated Statutes. It also contains the official comments of the advisory committee to proposed Subchapter A of Chapter 53 and the official comments of the National Conference of Commissioners on Uniform State Laws to proposed Chapter 54.
The official comments may be used in determining the legislative intent of the General Assembly. See 1 Pa.C.S. § 1939 and In re Martin's Estate, 365 Pa. 280, 74 A.2d 120 (1950).
